Event: Sealy Corporation's consolidated balance sheet at Aug. 26, 2007, showed $1.02 billion in total assets, $1.13 billion in total liabilities, and $16.2 million in common stock and options subject to redemption, resulting in a $128.4 million total stockholders' deficit. Net income for the third quarter was $21.5 million, compared to $29.4 million for the comparable period a year ago.
 
Intellectual Property: The Company has approximately 260 worldwide patents, of which the patents and pending patent applications relating to its UniCased technology, along with those patents that protect proprietary spring and coil designs, are believed to be its most valuable. These patents afford the Company multiple years of continuing protection of certain mattress designs. It has filed for patent protection for the core UniCased technology in 13 countries to date and expects similar competitive benefits from the issuance of those patents in those countries. The patents covering the proprietary spring and coil designs also provide Sealy with a competitive advantage in the U.S. and in other countries. The Company owns thousands of trademarks, tradenames, service marks, logos and design marks, including Sealy, Stearns & Foster and Posturepedic. The Company also licenses the Bassett and Pirelli tradenames in various territories under certain long term agreements. With the exception of the Sealy New Jersey license, the domestic licenses are predominantly trademark licenses. Of its 300 worldwide trademarks, the Company believes that the Sealy, Posturepedic, Stearns & Foster marks and affiliated logos are the most well known.
